General Terms and Conditions

The below terms and conditions are a binding legal agreement between yourself and Family Day Care Australia Ltd (FDCA). By submitting a request for a National Police History Check (NPHC), you acknowledge and agree that you have read and understood these terms and conditions.

  1. Data collection

    All sensitive data we receive is stored in an encrypted format in compliance with the Australian Privacy Act, all data we collect for NPHC is collected for the purpose of the check and the data we collect is stored for a minimum of 12 months and to be removed and deleted within 14 months of collection.

  2. Signed consent

    FDCA cannot release any National Police History Check information without receiving the applicant’s signed Application and Informed Consent Form and the required identity documents. The applicant agrees to have their identification document information verified with 3rd party organisations.

  3. Applicant's Obligation

    It is agreed that the applicant will review all information they have provided in their application before submitting, to ensure the information they have provided is accurate and correct. The applicant agrees that all identity documents they provide are their own. Any incorrect information supplied by the applicant will result in an invalid NPHC. FDCA will work with applicants who have completed an invalid NPHC and a check can be re submitted. If the application is still invalid after this consultation no refund will be provided.

  4. NPHC process

    The applicant understands that FDCA cannot expedite the NPHC process. The majority (around 70 per cent of all checks submitted) are completed in real-time and results returned to the applicant within minutes. Up to 30 per cent may be referred to one or more police agencies and can take longer than 10 business days to be returned because of the check’s complexity.

  5. Refunds

    FDCA is not required to provide a refund for:

    • Incorrect forms that are submitted by the applicant

    • Any data entry errors made by the applicant

    • National Police History Checks already submitted to the Australian Criminal Intelligence Commission (ACIC)

    • Submissions for checks we are not authorised to process

    • Change of mind after partially or fully completing the application process

    • Selection of the wrong check type and/or reason for check

    • Applicants that provide invalid or insufficient identity documents
